1 Agreement and eligibility
These Terms form an agreement between you and Etienne Dubarry, operating DocuHandsOn ("we," "us," or "our"). They apply to the website, software, technique libraries, educational materials, accounts, charts, and related services (the "Service"). Before creating an account or using an upload or publishing feature, you must affirmatively accept these Terms. If you do not agree, do not use those features.
You must be at least 18 and legally able to enter this agreement. If acting for a clinic, school, employer, or other organization, you represent that you have authority to bind that organization. The organization is responsible for use by its authorized personnel.
2 Purpose and professional responsibility
DocuHandsOn helps users organize, describe, illustrate, number, print, and share hands-on techniques. It is a documentation and educational reference tool. It does not diagnose a patient, prescribe treatment, certify a practitioner, or determine that a technique is appropriate for a particular person.
Only appropriately qualified individuals may perform procedures within their training, competence, license, and lawful scope of practice. Students may use the Service for education under appropriate supervision. You remain responsible for examination, screening, contraindications, informed treatment consent, clinical decisions, documentation, and outcomes. The Clinical Disclaimer is incorporated into these Terms.
3 Account access
Provide accurate account and professional information, safeguard your credentials, and report suspected unauthorized access promptly to contact@docuhandson.com. Do not share a personal account with unauthorized users, impersonate another practitioner, or misrepresent credentials. Administrative permissions do not authorize access to information beyond the scope of your role.
4 License to use the Service and our materials
Subject to these Terms and any applicable plan limits, we grant you a limited, nonexclusive, nontransferable license to use the Service for your own professional or educational purposes. You may create and use your technique charts, including printing or sharing exported charts through features we provide, subject to the rights attached to their content.
We and our licensors retain rights in the software, original text, photographs, illustrations, videos, branding, and other protected materials supplied through the Service. This license does not authorize extraction or republication of the full library, resale of our materials, redistribution of standalone source media, or copying the software. Preserve copyright and attribution notices in exported materials where provided. No trademark license is granted beyond identifying the Service accurately.
Nothing in these Terms claims exclusive ownership of unprotectable facts, ideas, clinical procedures, or techniques, or restricts activity that applicable law expressly permits.
5 Your content and permission to process it
You retain the rights you hold in content you upload or create. You are responsible for obtaining the copyright licenses, model permissions, patient authorizations, and other rights required for its intended use. A file found online is not automatically free to reuse.
You grant us a nonexclusive license to host, store, reproduce, resize, crop as instructed, convert, display, and transmit your content solely to provide, maintain, secure, and support the Service and the sharing settings you select. The license extends to service providers only as needed for those purposes. It does not transfer ownership to us or authorize unrelated advertising or reuse in our general technique library.
Public-library contribution, promotional reuse, or training an AI model on your uploads requires a separate, specific agreement or opt-in. Following deletion or account closure, our license ends except as necessary for lawful retention, backup expiration, dispute handling, or copies already shared with others under your instructions.
6 Patient information and prohibited uploads
Do not enter or upload identifiable patient information, clinical records, diagnoses linked to an individual, patient names or contact information, patient-linked treatment dates, health insurance identifiers, faces associated with care, or other protected health information. This restriction applies to charts, images, videos, audio, filenames, descriptions, support messages, and public links.
Unless we separately approve a specific workflow in writing and the required agreements and safeguards are in place, the Service is not authorized to receive protected health information. Do not assume that a password, private chart setting, or patient signature makes the Service suitable for that purpose. Keep official patient records in your authorized clinical record system.
If prohibited information is submitted accidentally, contact contact@docuhandson.com promptly using a general description and content identifier. Do not resend the sensitive material by email. We may restrict access or remove the material and take legally required measures.
7 Publishing and sharing charts
Before publishing, review every image, caption, technique description, and professional detail. Confirm that you have permission for public distribution and that no patient can be identified from the content or its context. A published professional chart describes techniques; it must not disclose an individual's treatment history.
Public content may be viewed, copied, indexed by search engines, downloaded, or redistributed by others. Editing or unpublishing cannot guarantee removal of copies, search caches, or printed materials outside our control. Editing credentials do not, by themselves, restrict viewing of a published chart. You must not describe a public link as confidential or patient-specific access control.
8 Acceptable use
Do not upload unlawful, infringing, exploitative, deceptive, or nonconsensual material; harass others; distribute malware; bypass access controls; interfere with the Service; scrape protected libraries at scale; or use another person's credentials. Do not use the Service to facilitate unlicensed practice, falsify treatment records, or make misleading claims about credentials, treatment effectiveness, or endorsement.
Do not reverse engineer or circumvent technical protections except to the extent expressly permitted by applicable law. Reasonable quotation, lawful criticism, and statutory rights are not prohibited.
9 Plans payments and cancellation
Any paid plan's price, billing interval, renewal terms, included features, and taxes will be disclosed before purchase. Recurring billing requires your affirmative authorization. Free access does not automatically convert to a paid subscription without authorization.
You may cancel future renewal using the cancellation method disclosed at checkout or by contacting contact@docuhandson.com. Cancellation ordinarily takes effect at the end of the paid period, unless the purchase terms or applicable law provide otherwise. Any refund terms will be displayed with the paid offer before purchase, subject to nonwaivable legal rights. Contact contact@docuhandson.com with a billing or refund request. Subscription payments are processed by Stripe through Dubarry Chiropractic Inc. for DocuHandsOn. Your selected plan renews until cancelled; cancel future renewal through Manage subscription. Material price or renewal changes will be communicated before taking effect as required by law. Payment processors may impose their own applicable terms.
10 Availability exports and changes
We may update, maintain, change, or discontinue features. We do not promise uninterrupted access or permanent availability of every library item. Where reasonably practicable, we will give advance notice of discontinuation that materially affects stored content or paid access and a reasonable opportunity to export available content.
Maintain your own lawful copies of charts and required clinical records. Exported charts may reflect a particular version and do not update automatically. Plan-specific access and retention rules must be stated when you subscribe; they do not override mandatory law.
11 No clinical or regulatory guarantees
We do not warrant that the Service or any chart meets every legal, licensing-board, insurer, recordkeeping, accreditation, or reimbursement requirement. No technique listing or educational document guarantees safety, effectiveness, legal defensibility, insurance payment, or continuity of care. You must verify completeness and accuracy before relying on or sharing a chart.
12 Warranty disclaimer
TO THE EXTENT PERMITTED BY LAW, THE SERVICE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT TO THE EXTENT SUCH WARRANTIES CAN LAWFULLY BE DISCLAIMED. WE DO NOT WARRANT THAT CONTENT IS ERROR-FREE OR THAT THE SERVICE WILL BE UNINTERRUPTED OR FREE FROM ALL SECURITY RISKS.
This disclaimer does not exclude warranties, obligations, or remedies that cannot lawfully be excluded, and does not override an express written commitment we make to you.
13 Limitation of liability
TO THE EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE, INCLUDING LOST PROFITS OR LOSS OF BUSINESS OPPORTUNITIES.
OUR TOTAL LIABILITY ARISING OUT OF THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, TO THE EXTENT SUCH A LIMIT IS LAWFUL.
These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, or liabilities and rights that applicable law does not permit us to exclude or limit. They do not release a treating practitioner from duties owed to patients or substitute for professional liability insurance.
14 Responsibility for third party claims
To the extent permitted by law, you will indemnify us against third-party claims, damages, and reasonable defense costs to the extent caused by your unlawful upload, infringement of another person's rights, unauthorized disclosure, or material breach of these Terms. This obligation does not cover claims to the extent caused by our own unlawful conduct, negligence, or breach.
We will promptly notify you of a covered claim and reasonably cooperate in its defense. No settlement may impose an admission, payment, or continuing obligation on us without our written consent. Mandatory consumer rights remain unaffected.
15 Suspension termination and rights complaints
We may suspend access or remove content when reasonably necessary to address a material breach, security threat, rights complaint, legal requirement, or risk to others. We will provide notice and an opportunity to address the issue when appropriate, except where immediate action is needed. You may stop using the Service or request account closure through contact@docuhandson.com. Lawful retention and existing payment obligations may survive closure.
Report copyright, privacy, or likeness complaints to contact@docuhandson.com with your contact details, the specific content or URL, the basis of your rights, and the requested action. Do not include patient records. We may request sufficient information to verify a complaint. A designated copyright-agent process, if adopted, will be published separately.
16 Governing law and disputes
These Terms are governed by the laws of Florida, without regard to conflict-of-law rules. Please first contact contact@docuhandson.com so we can attempt to resolve a concern. This does not delay an urgent legal remedy or override a statutory deadline.
Nothing requires arbitration, waives a jury trial, or waives a class action. Mandatory protections under the law of your residence remain available where applicable.
17 Updates and general provisions
We will publish the effective date and give reasonable notice of material changes. Where a change requires new consent, we will seek it; changes will not apply retroactively in a manner prohibited by law. These Terms, the incorporated Clinical Disclaimer, and Image Upload and Consent Rules govern use of the Service. The Privacy Policy describes data practices and does not waive privacy rights.
If a provision is unenforceable, the remainder continues to the extent lawful. Failure to enforce a provision is not a waiver. No user may bind us or represent an employment, agency, or clinical relationship with us. Contact contact@docuhandson.com regarding these Terms.
